Reminder: New AODA Accessibility Requirements for Small Employers in Ontario to Take Effect January 1, 2017

JANUARY 4, 2017

As of January 1, 2017, Ontario businesses and not-for-profit organizations with fewer than 50 employees must comply with new accessibility requirements under the Accessibility for Ontarians with Disabilities Act, 2005 ("AODA").

Accessible Formats and Communication Supports

Provide, upon request, accessible formats and communication supports to persons with disabilities. Notify the public about the availability of any accommodation process. These accommodation measures need to be provided in a timely manner at no additional cost than the regular cost charged to other persons.  In determining what accommodation to provide, the organization should consult with the person making the request.

Provide notification about the availability of accommodation for applicants with disabilities in the recruitment process.

Assessment or Selection Process

Jan. 1, 2017

Provide notification about the availability of accommodation for applicants with disabilities who are selected to participate in an assessment or selection process. If a request for accommodation is made, consult with the applicant and provide or arrange for suitable accommodation.

Notice to Successful Applicants

Jan. 1, 2017

Provide notification of policies for accommodating employees with disabilities upon making offers of employment.

Informing Employees of Supports

Jan. 1, 2017

Provide notification of policies for accommodating employees with disabilities to all employees as well as notifications of any updates to existing policies.

Accessible formats and Communication Supports

Jan. 1, 2017

Provide, upon request, accessible formats and communication supports for information that is needed by the employee to perform their job, and for information that is generally available to employees in the workplace.  The employer must consult with the employee requesting accommodation to determine the suitable accommodation.


Performance Management

Take into account accessibility needs of employees with disabilities and individual accommodation plans when using a performance management process in respect of employees with disabilities.

Career Development and Advancement

Take into account accessibility needs of employees with disabilities and individual accommodation plans when providing career development and advancement in respect of employees with disabilities.

Redeployment

Jan. 1, 2017

Take into account accessibility needs of employees with disabilities and individual accommodation plans when using redeployment in respect of employees with disabilities.
