Nikiforos Iatrou discusses merger approval for Canadian fertilizer producers with Reuters

Reuters, SEPTEMBER 6, 2016

Nikiforos Iatrou, competition chair at WeirFoulds spoke to Reuters saying the proposed merger of two major Canadian fertilizer producers is more likely to be approved in Canada than the United States.

Potash Corp of Saskatchewan and Agrium Inc confirmed merger talks on Tuesday, August 30, 2016.

While the US may fear the anti-competition effects of the merger, Canada is likely to look favourably on the efficiency gains that would be achieved.

Niki believes it is likely the efficiencies defence that will help the merger win approval in Canada.

"It's possible that in this case the efficiencies win the day in Canada but don't carry the day in the United States," he said.

Despite approval in Canada, it is still possible for the US Federal Trade Commission to reject the deal, potentially leading to it being dropped completely.

Niki is recognized by Chambers Global as one of Canada's leading competition lawyers.
