Privacy and Access to Information

OVERVIEW - Privacy and Access to Information

Public demands for access to government documents and information must be carefully weighed against concerns about the gathering and use of personal information. In recent years, Canadian governments have addressed these concerns by implementing access to information and privacy legislation. We have significant experience advising governments and other public bodies in legislating governing both these areas, including:

  • Businesses regarding the federal Personal Information Protection and Electronic Documents Act;

  • Municipalities regarding the Municipal Freedom of Information and Protection of Privacy Act;

  • Governmental institutions and agencies regarding the provincial Freedom of Information and Protection of Privacy Act;

  • Universities, colleges and other educational institutions including schools and school boards regarding the provincial Freedom of Information and Protection of Privacy Act;

  • Healthcare providers regarding the Personal Health Information Protection Act including hospitals that will, as of January 2012, be subject to Freedom of Information and Protection of Privacy Act; and

  • Regulatory bodies regarding privacy and confidentiality.

Where such cases lead to hearings or litigation, we provide comprehensive representation to our public sector clients in these matters.
