Among the firm's many significant cases in this area are the following:

  • We acted as Ontario counsel for WestJet in its litigation (now settled) with Air Canada. Air Canada v. WestJet Airlines Ltd. (2006), 81 O.R. (3d) 48 (S.C.J.). This decision is ranked as #1 in the Top Ten Business Cases of 2006 in Canada by Lexpert.

  • We represented Canadian Airlines, then one of Canada's major carriers, on the leading case in Canada and internationally on when turbulence is an "accident" under article 17 of the Convention for the Unification of Certain Rules Relating to International Coverage by Air (Warsaw Convention). Quinn v. Canadian Airlines International (1994), 18 O.R. (3d) 326 (Gen. Div.), aff'd [1997] O.J. No. 182 (C.A.). This case has been cited numerous times in foreign courts, including in the House of Lords (Deep Vein Thrombosis and Air Travel Group Litigation, [2005] UKHL 72) and the Court of Appeals for the Second Circuit (Magan v. Lufthansa German Airlines, 339 F.3d 158 (2d Cir. 2003)).

  • We acted for leading Canadian and UK corporations in the airline vacation industry with respect to litigation concerning a share purchase transaction raising issues of breach of fiduciary duty, inducement of breach of contract, interference with economic interests, defamation and injunctive relief.
