LAND USE PLANNING - Expropriations

Expropriation claims arise when government agencies acquire privately owned land for public projects. Expropriation issues can also arise when no land is taken because an authority carries out public works in the vicinity of privately owned land which affects its use and value. Due in part to the land-use and planning history which may precede the expropriation or public work in any given case, expropriation often leads to complex claims which require specialized expertise. We represent both expropriating authorities and land owners before the Ontario Municipal Board, Federal tribunals and the courts.

We have been involved in virtually every major expropriation of land in Ontario, from numerous expropriations for infrastructure and city-building projects – including the expropriation of land for most of Ontario's 400 series highways – to the largest expropriation of land in Ontario's history, for the Seaton community, in the Town of Pickering.
