In recent years, the Competition Bureau has been increasingly willing to litigate merger cases in which it believes that a proposed transaction may substantially prevent or lessen competition. Lawyers in the earlier years of their competition practice are often well-versed in the ins and outs of merger review, but merger litigation presents its own set of considerations. When faced with a contested merger, how do you decide whether contest an order and when to resolve? How does preparing for a merger litigation case differ from preparing for an ordinary course merger review and what are some best practices for developing your case?
