Recent developments relating to remedies in human rights cases seemingly pull in opposite directions. Tribunals have issued record-high damages awards for injury to dignity and have upheld complex group and systemic claims. Yet several provinces, recently joined by Manitoba, expressly limit these damages. Moreover, the Supreme Court of Canada, in one landmark case, held that unionized employees cannot bring claims before statutory human rights tribunals and must instead proceed through arbitration; in another, the Court greatly narrowed the basis on which claims involving discriminatory speech can be brought. Is access to redress for human rights violations increasing or diminishing? How can claimants and respondents know in which forum to bring claims and what remedies to seek? In this session, a panel of experts will analyze these conflicting developments and offer guidance to workplace parties.
