When litigating a contentious estate in Canada, it’s not unusual to find that the estate has foreign assets: a bank account in the deceased’s native country, a holiday home on the shores of a sunny Caribbean island, or a foreign trust set up in an international financial center. Dealing with these foreign assets may require Ontario-based practitioners to navigate the laws and court systems of multiple jurisdictions, and can raise a wide range of issues including a conflict of laws, or the need to consider compliance with anti-corruption and anti-money laundering legislation. It can be difficult to figure out where to start and how to find the legal assistance that your clients may need in a foreign jurisdiction.
