Bidding & Tendering – The Construction Institute of Canada

Partners Krista Chaytor and Michael Swartz will serve as instructors during Bidding & Tendering, a two-part webinar course that will be offered by The Construction Institute of Canada on Wednesday, April 3rd and Tuesday, April 9th, 2024.

Tendering (i.e., procurement) is often the gateway to securing construction contracts. It can be a lengthy and complicated process with its own special legal rules. Running afoul of those rules could not only be the difference between awarding or winning a contract versus losing out, but it could also put you and your company at great legal risk if not done properly.

This 6-hour course will look at some of the most common types of procurement, the legal rules involved in procurement, how to ensure you comply with those rules and the common pitfalls to avoid.

This course will cover the following topics:

  • The fundamentals of the contracting process as it relates to bidding and tendering;
    Understanding key terminology used in the process;
    The differences between Tendering and RFPs;
    Understanding key guidelines and legal principles;
    What to be aware of when reviewing Instructions to Tenderers or Instructions to Proponents;
    What is “substantial compliance”?;
    How to avoid submitting a bid or proposal that is non-compliant;
    What happens if you submit a non-compliant bid?;
    What happens when a non-compliant bid is awarded the contract?
