Estates Litigation

Among the firm’s many significant cases in this area are the following:

  • We acted on the first Ontario case permitting a trustee of a perpetual trust and its beneficiary charities to adopt the “total return” investment model. Toronto Aged Men’s and Women’s Homes v. Loyal True Blue and Orange Home (2003), 68 O.R. (3d) 777 (S.C.J.).
  • We acted for the executor in this landmark case in which the Supreme Court of Canada declared Ontario’s probate fee (as it then was) unconstitutional because the province had charged a tax, rather than a fee. Re Eurig Estate, [1998] 2 S.C.R. 565.
  • We acted for the estate of Harold E. Ballard in a case involving allegations by a minority shareholder of oppression in a corporation created to effect an estate freeze. 820099 Ontario Inc. v. Harold E. Ballard Ltd. (1991), 3 B.L.R. (2d) 113 (Ont. Div. Ct.).
