CNAR Spring Workshop – Addressing Conflict and Bias in the Complaints and Discipline Process

WeirFoulds Partners Jill Dougherty and Debra McKenna, and Associate Natasha Novac will be speaking at “Both Sides Now: Addressing Conflict and Bias in the Complaints and Discipline Process,” a spring workshop hosted by the Canadian Network of Agencies for Regulation (CNAR), on June 11 from 2:30 to 4:00 p.m.

This session will explore how conflict of interest and bias can arise at various stages of complaints and discipline processes, and the importance of maintaining impartiality to support fair, defensible outcomes and public confidence in regulatory bodies. Drawing on recent legal developments and practical experience, the speakers will examine the evolving standards applied to bias, including how even perceived bias can affect proceedings and decisions.

Attendees will gain practical guidance on recognizing and addressing bias risks, including best practices for screening and disclosure, managing overlapping roles, and responding to allegations as they arise. The discussion will also offer actionable strategies to help regulators balance procedural fairness with operational effectiveness across their adjudicative processes.
