Practical Skills in Tax Litigation: Discovery – Ontario Bar Association

Tax lawyer Michael Ding will serve as program co-chair for Practical Skills in Tax Litigation: Discovery, which will be hosted by the Ontario Bar Association's Taxation Law Section on Monday, November 10, 2025.

The program will provide hands-on strategies and practical tools to efficiently navigate the discovery process in tax litigation, all while avoiding common pitfalls. Develop a clear understanding of procedural rules, best practices, and tactical considerations at each stage of discovery, including:

  • Navigating Rule 81 vs. Rule 82 requirements; preparing privilege logs
  • Oral vs. written examinations, preparing witnesses, and managing the examination process
  • Scope of discovery including train of inquiry test
  • Understanding and clarifying obligations in undertakings, managing timelines, and addressing disputes over scope
  • Best practices for follow-up questions
  • How to avoid refusals motions and practical tips for bringing and responding
