WeirFoulds Partner Daniel Wong comments on technology driven fraud in the workplace in Human Resources Director Canada

Partner Daniel Wong, Chair of WeirFoulds’ Employment & Labour Practice Group, was quoted in an article written by Cris Davis for Human Resources Director Canada on January 24th, 2025.

The article focuses on technologies that have transformed the workplace, bringing new concerns pertaining to employment-related fraud and misconduct with them. Dan commented on the increasing prevalence of employees being coerced into committing fraudulent activities throughout sophisticated digital blackmail, commenting that “We’ve seen employees who are what I describe as the reluctant pawn of a third party.” Methods used to blackmail employees compromising data and AI-generated deepfakes.

Dan said that organizations can protect themselves by implementing fundamental shifts at the cultural and structural level, “creating an open-door policy where people feel comfortable in asking questions and seeking guidance” and being aware of red flags that could indicate an employee is engaged in fraudulent activities.

However, Dan advised that when investigating potentially fraudulent behaviour, “organizations should make sure that they don’t get too aggressive or excited with investigations” in order to avoid creating additional legal issues, since different jurisdictions impose varying regulations on how employee information can be collected and used in investigations.
