Robert Eisenberg and Lisa Borsook will be attending ICSC+ Canadian Law, a two-day conference on September 21-22, 2022. The conference is part of the ICSC+ series of events, delivering discipline-specific, forward-thinking content for the creators, designers, builders and thinkers that define contemporary marketplaces and spaces where people shop, dine, work, play and gather.
Robert Eisenberg will moderate a workshop titled “You Don’t Have to Go Home, But you Can’t Stay Here: or Can You?): Issues and Approaches to Redeveloping Tenanted Properties” from 1:00 pm – 2:15 pm on Day 1 of the conference. The workshop will involve a discussion about the growing pace of redevelopment of existing tenanted assets, focusing on issues such as what rights a tenant can rely on to protect its business and increase its leverage, how parties can negotiate a solution to save the business relationship, and more.
Lisa Borsook will participate in a multi-part plenary session titled “Anchors Away – A Deep Dive into the Co-Tenancy Waters”, from 2:15 pm – 3:30 pm on Day 1, presenting the fourth section, “The Implementation of Co-Tenancy Rights.” Lisa’s section will focus on potential obstacles to exercising co-tenancy rights, and features a general discussion on principles relating to fairness and reasonableness and other circumstances in which courts have restricted a tenant’s co-tenancy rights.
